Service Description

Florida Pest Control provides residential, commercial, and industrial pest management services throughout the State of Florida. Our services include, but are not limited to, general pest control, termite inspection and treatment, rodent exclusion, mosquito control, lawn and ornamental pest management, bed bug treatment, and wildlife removal. Specific service offerings, treatment methods, and service frequencies are determined based on property inspection, pest identification, and the customized service agreement executed for each customer. All services are performed by licensed pest control operators in accordance with Florida Department of Agriculture and Consumer Services regulations. Service appointments are scheduled during normal business hours, with emergency services available in select markets subject to additional fees. We reserve the right to modify service protocols based on seasonal pest pressures, regulatory changes, or safety considerations without prior notice.

No Guarantee or Warranty

Florida Pest Control makes no express or implied guarantees regarding the complete elimination of pests from any treated property. Pest biology, environmental conditions, neighboring property conditions, and customer cooperation significantly influence treatment outcomes. While we employ industry-standard techniques and EPA-registered products, we do not warrant that pests will not return between scheduled services or that re-infestation will not occur. Our service agreements do not constitute a warranty of results. Any retreatment services provided under a maintenance program are limited to the specific pests covered under that program and are subject to inspection verification. Wood-destroying organism treatments carry the specific terms and limitations outlined in the separate WDO treatment contract and any applicable warranty documents, which are distinct from these general terms.

User Responsibilities

Customers must provide accurate property information, including known allergies, pets, water sources, and prior pest control treatments. You agree to prepare the property as instructed prior to service, which may include removing food items, securing valuables, vacating premises during treatment when required, and keeping children and pets away from treated areas for the specified re-entry interval. Customers must promptly report pest activity between scheduled services to qualify for any covered retreatment. Failure to follow post-treatment instructions, structural modifications without notification, or interference with treatment barriers may void service commitments. You are responsible for maintaining structural integrity, addressing moisture issues, and eliminating conducive conditions that attract pests. Payment is due according to the terms of your service agreement, and continued service may be suspended for non-payment without relieving your obligation for charges incurred.

Limitation of Liability

To the maximum extent permitted by Florida law, Florida Pest Control's total liability arising from or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim in the twelve months preceding the incident. We shall not be liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to property damage, loss of use, business interruption, or personal injury, except where caused by our gross negligence or willful misconduct. We are not responsible for damage to personal property, landscaping, or structures resulting from pre-existing conditions, customer failure to disclose relevant information, or acts of third parties. Claims must be reported in writing within thirty days of the service date or discovery of the alleged issue. This limitation applies regardless of the legal theory asserted, whether contract, tort, strict liability, or otherwise.

Intellectual Property

All content on Florida Pest Control websites, marketing materials, service marks, logos, trade names, proprietary treatment protocols, and technical documentation are the exclusive property of Florida Pest Control or its licensors. Customers and website users are granted no license to reproduce, distribute, modify, create derivative works from, or commercially exploit any protected materials without express written authorization. Unauthorized use of our intellectual property constitutes infringement and may result in legal action. Feedback or suggestions provided to Florida Pest Control may be used without restriction or compensation. Third-party trademarks referenced in our materials remain the property of their respective owners.

Governing Law

These Terms of Service and any disputes arising from our services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Alachua County, Florida, or the county where the service was performed. You consent to the personal jurisdiction and venue of such courts. The parties waive any right to jury trial in disputes arising under these terms. If any provision is held invalid under Florida law, the remaining provisions shall continue in full effect. These terms do not create any third-party beneficiary rights.

Changes to Terms

Florida Pest Control reserves the right to modify these Terms of Service at any time. Material changes will be communicated through direct notice to active customers, website posting, or other reasonable means. Continued use of our services after changes take effect constitutes acceptance of the revised terms. Customers with written service agreements in effect at the time of modification shall be subject to the terms in place at agreement execution until renewal or amendment, except for changes required by law or regulation. We encourage periodic review of these terms. The effective date at the top of this document indicates the most recent revision.
